Terms of Service for Illustration

Rights to the Work
As the commissioner, you reserve the right to redistribute, resell, and modify the piece on your own volition. However, you do not reserve the right to claim the work as your own and it must be credited appropriately.
As the artist, I reserve the right to publicly upload the commissioned piece to social media and use it as an example for future commissions and other advertisements.
I will claim no rights to your character, nor anyone else’s, in the piece.

Pricing and Payment
The final price agreed upon will not be altered, however there may be additional charges incurred for revisions. (See "Revisions")
PayPal is my only mode of payment.

Time Expectancy
Commissions are typically completed within 2-6 weeks.
A rush fee of 50% will be charged for commissions requesting to be expedited or moved up in my queue.

Process
I do not send WIPs except on a whim if I so choose. However, I will send WIPs when requested.
I do not send progress updates except on a whim if I so choose, though I will likely give you an estimated time for when I will begin work.
I will also send progress updates when asked. -
Shipping
I do not print and ship commissions.

Revisions
One minor revision is permitted during the sketch phase*. All additional revisions, major and minor, will require a surcharge of at least $5USD.
Redoing an entire sketch will be an additional surcharge starting at $15USD depending on the type of commission purchased.
*Please ensure you have requested to see the completed sketch in order to take advantage of the free revision.

Revisions Period
After completing your commission, I will no longer work on or modify it. If you come to me after I’ve finished the commission, and you point out something that you would like modified, I will not take it upon myself to fix it.

Misplacement of Images and Files
If you’ve lost the commission file, please contact me and I will see what I can do.
However, if I am unable to get the file for you, do not ask me for a refund, as I have done my part in creating the commission and am not responsible for any misplaced files.

Client or Third Party "Corrections"
If you—the client, or someone else (friend, family, stranger, and so on) take the finished product and “correct” the piece in whatever way, be it major or minor, you have no right to come to me and claim that I need to fix or restore it. I did not make the modification; I am not responsible.

Cancellation and Refunds
All final purchases are non-refundable.
However, should I be unable to finish the piece due to an emergency, I will refund you.
If I have only worked on the sketch, I will refund you 75% of the base price; line-art and coloring stages will result in a refund of 40%; shading, and near completion stages will not be refunded.
Refund percentages are taken from the base commission price and do not include revision charges and rush fees.

Confidentiality
All contact between the Client and I will be kept confidential.

Final Agreement
All articles of these Terms of Service are relevant unless specifically redefined in the final written agreement between the Client and I.

Rights to the Work
For character designs: As the character's owner, you reserve the right to redistribute, resell, and modify it on your own volition. However, you do not reserve the right to claim the original design and artwork as your own and it must be credited appropriately. You may claim credit for modifications, redesigns, and any other versions of the original design.
As the artist, I reserve the right to publicly upload the commissioned piece to social media and use it as an example for future design work, commissions, and other advertisements.
I will claim no ownership of the character aside from the creation of the original design.

Selling and Trading
The prices I set for my designs and sell them for establishes their base monetary worth.
Any additional content of the character may increase their value, regardless of it being commissioned work or not. Therefore I do not discourage you from selling the character for more than you purchased/traded it for once the value has increased. This is valid for gifted/raffled designs as well.

For character designs: I will present my initial concept to you and make 2 minor revisions free of charge. After those 2 minor revisions are used, the other revisions terms apply.
Two minor revisions are permitted during the concept phase for character design commissions, and one minor revision is permitted during the sketch phase* for character design and reference sheet commissions. All additional revisions, major and minor, will require a surcharge of at least $5USD.

Confidentiality
All contact between the Client and I will be kept confidential. This does not apply to a barter/sale that has been provoked publicly but will apply immediately upon further private discussion.
